Employment Visa I-9 Form
I-9 Basics
Any individual hired in the United States, including US citizens, must complete filling out the Form I-9, or Employment Eligibility Verification form. Along with the form, they must provide evidence of eligibility to work and earn compensation. This evidence must be provided within 3 days of commencement of work. If the employee does not provide the evidence within the 3 days, the employer has the right to terminate employment. The following are some of the types of acceptable documentation the employee can provide: US passport or US passport card; permanent resident card or Alien registration receipt card (I-551); employment authorization document (I-766) that contains a photograph; driver's license with a birth certificate; and, many other combinations of documents. The list of approved evidences is listed on the Form I-9.
Employers must keep accurate files of I-9 forms and re-verifications. A business can computerize its I-9 storage which is recommended. It also greatly assists businesses to audit their records and ensure they are in compliance with the law. An El Paso immigration attorney can help in all aspects of I-9 issues for individuals and businesses.
